Overview

These Terms of Service (the "Terms") govern use of the Cassiel Pet websites and services operated within the brand business structure by Hong Kong Hengxin Ruizhi Co., Limited and Guangzhou Jichong Information Technology Co., Ltd. (collectively, "Cassiel Pet", "we", "us", or "our"). The entity identified in the relevant transaction, payment record, service notice or regional communication may perform the applicable commercial, customer-service, technical or regional function. These Terms apply to https://www.cassielpet.com and all regional subdomains (each a "Site", collectively the "Sites"), together with the content, services and products available through them (the "Services").

Cassiel Pet is the consumer-facing brand. Products are manufactured by our licensed manufacturing partner, Changsha ToDear Pharmaceutical Co., Ltd. (Unified Social Credit Code: 91430181MAD3X71Y73), a GMP-certified veterinary pharmaceutical facility (GMP Certificate No.: (2024) GMP 18003).

By accessing or using the Sites or Services in any way, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use or access the Sites.

1. Changes to These Terms

We may update these Terms from time to time at our sole discretion. When we do, we will update the "Last Updated" date at the top of this page and notify you by posting a notice on the Sites or via email where appropriate. It is your responsibility to review these Terms periodically. Your continued use of the Sites or Services after any changes constitutes your acceptance of the updated Terms.

3. Eligibility & User Accounts

3.1 Eligibility To use the Sites and Services, you must have reached the age of majority in your jurisdiction and have the legal capacity to enter into these Terms.

3.2 Account Creation When placing an order or creating an account, you must provide accurate, complete, and current information. You are responsible for keeping your account information up to date. You may not:

• Impersonate another person or create an account on behalf of someone else without their consent
• Share your login credentials with any third party
• Create multiple accounts for the same individual

You are fully responsible for all activities that occur under your account credentials. If you believe your account has been compromised, contact us immediately at support@cassielpet.com.

3.3 Account Termination We reserve the right to suspend, restrict, or terminate your account or access to the Sites and Services at any time, in our sole discretion, if we determine that your use is inconsistent with these Terms.

4. Use of the Sites & Services

4.1 Limited License Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Sites and Services for personal, non-commercial purposes.

4.2 Prohibited Uses In connection with your use of the Sites and Services, you agree that you will not:

• Reproduce, duplicate, copy, sell, resell, or otherwise exploit any portion of the Sites or Services for any commercial purpose without our express written consent
• Access, retrieve, scrape, index, or download any content through automated means including spiders, bots, or hacking tools
• Attempt to gain unauthorized access to the Sites, other users' accounts, or connected systems
• Remove, disable, or circumvent any security features of the Sites or Services
• Post or upload any content that is defamatory, illegal, infringing, threatening, hateful, obscene, or otherwise objectionable
• Interfere with or disrupt the operation of the Sites or Services or other users' access to them
• Violate any applicable local, state, national, or international law or regulation

4.3 User-Submitted Content By posting, uploading, or submitting any content to the Sites or Services, you grant Cassiel Pet a perpetual, royalty-free, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, adapt, publish, translate, publicly display, create derivative works from, and distribute such content in any media or format now known or later developed.

You represent and warrant that: (i) you own the content or have the right to grant us the above license, and (ii) your content does not violate any third party's privacy rights, intellectual property rights, or any applicable law.

4.4 Site Availability We may modify, suspend, or discontinue the Sites or Services at any time without notice. We are not liable for any interruptions, delays, or failures resulting from causes beyond our reasonable control.

5. Intellectual Property

All content on the Sites and Services — including text, graphics, logos, images, audio clips, product descriptions, and software — is the exclusive property of Cassiel Pet, Hong Kong Hengxin Ruizhi Co., Limited, Guangzhou Jichong Information Technology Co., Ltd., or their licensors, and is protected under United States and international copyright law.

The Cassiel Pet name, logo, and all associated trademarks, service marks, and trade dress are the property of Hong Kong Hengxin Ruizhi Co., Limited. These trademarks may not be used in connection with any product or service not affiliated with Cassiel Pet, in any manner likely to cause confusion, or in any manner that disparages or discredits Cassiel Pet.

No license or right to any trademark is granted by implication, estoppel, or otherwise through your use of the Sites or Services.

6. Third-Party Links

The Sites and Services may contain links to third-party websites or applications for your convenience. Cassiel Pet does not control, endorse, or assume responsibility for the content or availability of any third-party site. Your use of any third-party site is at your own risk. Cassiel Pet and its affiliates, officers, directors, employees, and agents shall not be liable for any damages arising from your use of or reliance on third-party sites or content.

7. Disclaimer of Warranties

The sites, services, and all information provided through the sites and services are provided on an "as is" and "as available" basis without warranties of any kind.

To the maximum extent permitted by applicable law, Cassiel Pet, Hong Kong Hengxin Ruizhi Co., Limited and Guangzhou Jichong Information Technology Co., Ltd. expressly disclaim all warranties, express or implied, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties that the sites or services will meet your requirements
• Warranties that the sites or services will be uninterrupted, timely, secure, or error-free
• Warranties regarding the accuracy or reliability of any information obtained through the sites or services
• Your use of the sites and services is entirely at your own risk.

8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Cassiel Pet, Hong Kong Hengxin Ruizhi Co., Limited, Guangzhou Jichong Information Technology Co., Ltd., or their respective officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the sites or services, even if advised of the possibility of such damages.

Our total liability to you for any claims arising under these terms shall not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim.

9. Digital Millennium Copyright Act (DMCA)

6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

10. Governing Law & Dispute Resolution

10.1 Governing Law These Terms and any disputes arising out of or related to your use of the Sites or Services shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

10.2 Jurisdiction You agree to submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California for resolution of any disputes not subject to arbitration under these Terms.

10.3 Dispute Resolution — Arbitration For any dispute or claim arising out of or relating to these Terms or the Sites and Services, the parties agree to first attempt to resolve the dispute informally by contacting us at support@cassielpet.com. If the dispute cannot be resolved informally within thirty (30) days, either party may submit the dispute to binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA), conducted in Los Angeles, California.

The arbitrator's decision shall be final and binding. Each party shall bear its own costs and attorneys' fees unless the arbitrator determines otherwise.

10.4 Class Action Waiver You and Cassiel Pet agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

10.5 Jury Trial Waiver To the extent permitted by law, both parties waive the right to a jury trial for any dispute arising under these Terms.

11. Severability & Entire Agreement

If any provision of these Terms is found to be illegal, invalid, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, Refund & Return Policy, and Shipping Policy, constitute the entire agreement between you and Cassiel Pet regarding your use of the Sites and Services, and supersede all prior agreements whether written or oral.

12. Notice & Communications

You agree that Cassiel Pet may communicate with you via email, postal mail, or by posting notices on the Sites. You consent to receive electronic communications from us and agree that all such communications satisfy any legal requirement that communications be in writing.

13. SMS / MMS Mobile Marketing Program Terms

Program Overview

Cassiel Pet ("we", "us", "our") operates an optional SMS/MMS mobile messaging program (the "Program") to keep customers informed about product updates, promotions, order status, and pet health tips. Participation in the Program is entirely voluntary.

By opting into the Program, you agree to these SMS Terms, which are incorporated into and form part of these Terms of Service.

Opt-In

You may opt into the Program by:

• Checking the SMS opt-in box at checkout on cassielpet.com
• Texting a designated keyword to our Program number
• Completing an online enrollment form on our Sites

By opting in, you consent to receive recurring automated marketing and transactional SMS/MMS messages from Cassiel Pet at the mobile number you provide. Consent is not a condition of any purchase. Message and data rates may apply.

What to Expect

Messages from the Program may include:

• Order confirmations, shipping updates, and delivery notifications
• Product recommendations based on your purchase history
• Promotional offers, seasonal sales, and new product launches
• Pet health tips and care reminders related to Cassiel Pet products
• Checkout reminders for abandoned carts

Message frequency varies based on your activity and preferences. You can expect to receive between 2–8 messages per month on average.

Opt-Out

To stop receiving SMS messages from Cassiel Pet at any time, reply STOP to any message we send. You may also reply END, CANCEL, UNSUBSCRIBE, or QUIT. After opting out, you will receive one final confirmation message. No further messages will be sent unless you opt back in.

Please note: only the exact keywords listed above will be recognized as opt-out requests. Modified versions (e.g., "please stop" or "stop messages") may not be processed automatically.

Costs

Standard message and data rates from your wireless carrier may apply. Cassiel Pet does not charge additional fees for SMS messages.

Carrier Disclaimer

Delivery of SMS messages is subject to effective transmission from your wireless carrier and is outside our control. Cassiel Pet and participating carriers are not liable for delayed or undelivered messages. The Program may not be available on all carriers or devices.

Eligibility

You must be at least 13 years of age to participate in the Program. Users between 13 and 18 years of age must have parental or legal guardian consent. By participating, you confirm you meet these age requirements.

Prohibited Content

You agree not to send prohibited content via any two-way SMS interaction with Cassiel Pet, including content that is fraudulent, harassing, threatening, obscene, illegal, or in violation of any applicable law or regulation.

MMS

If your device does not support MMS messaging, the Program will default to SMS text messages.

Florida Residents

Cassiel Pet endeavors to comply with the Florida Telemarketing Act and Florida Do Not Call Act for Florida residents. For compliance purposes, you will be considered a Florida resident if your shipping address or opt-in phone area code is a Florida area code at the time of enrollment. Mobile messages sent by Cassiel Pet directly in response to your requests (including keyword responses, opt-in confirmations, help and stop requests, and shipping notifications) shall not constitute a "telephonic sales call" under Florida Statutes Section 501 to the extent applicable.

Changes to SMS Terms

We reserve the right to modify these SMS Terms at any time. Material changes will be communicated via SMS or posted on our Sites. Continued participation in the Program after changes constitutes your acceptance of the updated terms.
